Terms of Service for BidCrunch

1. WHO YOU'RE CONTRACTING WITH

These Terms of Service are between you and Bidcrunch, the seller and operator of the BidCrunch web application ("we", "our", "us"). By creating an account or continuing to use the service, you agree to these terms. If you use the service on behalf of a company, you confirm you have authority to bind that company.

2. THE SERVICE

BidCrunch provides an automated, self-service estimating and takeoff utility for UK construction projects. All calculations, metric outputs, VAT estimations, and Construction Industry Scheme (CIS) tax line items are provided as estimates for guidance purposes only.

3. NO PROFESSIONAL ADVICE

BidCrunch is a software tool and does not constitute formal Quantity Surveying, legal, or financial accounting advice. Automated outputs may be inaccurate. Users are entirely responsible for verifying final contract bids and material quantities before entering into binding commercial agreements.

4. ACCEPTABLE USE

You must not misuse the service. This includes: using it for anything unlawful; fraud or spam; infringing anyone's intellectual property; uploading malware or interfering with the service's security; probing, scanning or scraping the service; attempting to reverse engineer it; reselling or redistributing access; or circumventing plan limits. You are responsible for the content you upload, for how you use the outputs, and for having the rights to any files you submit.

5. INTELLECTUAL PROPERTY

We own the service and all its intellectual property, including the software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You keep ownership of the blueprints and data you upload; you grant us a limited licence to host and process that content solely to provide the service to you.

6. SUBSCRIPTIONS & CANCELLATIONS

  • Both plans start with a 14-day free trial. You won't be charged if you cancel before the trial ends.
  • Solo subscriptions are billed monthly at £49/month (1 user).
  • Company subscriptions are billed monthly at £149/month (up to 5 users).
  • You can cancel your monthly subscription at any time directly through your billing dashboard. Access will remain active until the end of your current billing cycle.

7. PAYMENTS & REFUNDS

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for how to request a refund.

8. SERVICE LEVEL

We work hard to keep BidCrunch available, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

9. SUSPENSION & TERMINATION

We may suspend or terminate your access if you materially breach these terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. When your access ends, your data is handled as described in our Privacy Policy.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by UK law, Bidcrunch shall not be liable for any indirect, consequential or special damages — including loss of profits, data or goodwill — or for any financial losses, budget overruns, or missed project tenders resulting from the use or misinterpretation of our automated estimating calculations. Our total aggregate liability is capped at the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.

11. GOVERNING LAW

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
